Terms of Service

By creating an account or using Clipbuild.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Second Mile Productions LLC ("Company," "we," "us," or "our").

Clipbuild is an AI-powered social media management platform that helps small businesses create, schedule, and automatically publish content to social media platforms including Facebook, Instagram, YouTube, and TikTok. The Service uses artificial intelligence to generate captions and content based on information you provide about your business.

You must create an account to use Clipbuild. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account.

You retain ownership of all content you upload to Clipbuild, including photos, videos, and business information. By using the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely to provide the Service to you — including generating posts and publishing them to social media platforms you authorize. You represent and warrant that:

• You own or have the right to use all content you upload.
• Your content does not violate any third-party intellectual property rights.
• Your content complies with the terms of service of each social media platform you connect.
• You have the authority to connect the social media accounts and pages you link to Clipbuild.

By connecting your social media accounts, you authorize Clipbuild to post content on your behalf using the permissions you grant during the OAuth authorization process. You are responsible for ensuring that the content posted through Clipbuild complies with the terms of service and community guidelines of each social media platform. We are not responsible for content that violates platform policies or for any resulting account suspension or termination by a social media platform.

Clipbuild uses artificial intelligence to generate captions, hashtags, and other content for your business. While we strive for quality and relevance, AI-generated content may occasionally be inaccurate, inappropriate, or not perfectly suited to your brand. You are responsible for reviewing and approving all content before it is published. We encourage you to use the approval workflow to review posts before they go live.

You agree not to use Clipbuild to:

• Post content that is illegal, defamatory, harassing, or harmful.
• Violate any applicable laws or regulations.
• Infringe on intellectual property rights of others.
• Post spam, misleading information, or deceptive content.
• Attempt to gain unauthorized access to our systems.
• Use the Service to compete with or reverse-engineer Clipbuild.

We aim for high availability but do not guarantee uninterrupted service. Scheduled posts may occasionally fail to publish due to technical issues, social media platform outages, or expired access tokens. We are not liable for missed posts or any resulting business impact. We recommend periodically verifying that your connected accounts remain active.

To the maximum extent permitted by law, Second Mile Productions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

You agree to indemnify and hold harmless Second Mile Productions LLC, its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ends immediately and we will delete your data in accordance with our Privacy Policy.

We may update these Terms at any time. We will notify you of material changes by email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Texas.
